Media Activist in San Francisco Makes National
Call to Action to Occupy Wells Fargo Bank Officers With Lawsuits

San Francisco-A San Francisco Media Activist, Jackie Wright, is making an appeal to all homeowners and those affected by foreclosure to "Occupy" the Banks in Court.  Wright is urging people to take individual action and file lawsuits in their state and federal courts legal actions against Wells Fargo Bank and other banks and their officers for its duplicity in the financial melt down of the United States of America.

“The Prophet Habakkuk has exposed the condition we face ‘they rejoice as those feeding on the poor in secret.’  As surely as greedy executives gathered and toasted among themselves over the schemes to defraud the poor, the corporations they gathered within and the individuals must be made accountable for their actions,” said Wright.  “My one individual lawsuit may be ignored and easily dismissed by the courts but as millions across this nation take their power and hit Wells Fargo where it hurts in the pocketbook as they face the people they have brutalized, they will have to pay attention.”

Wright filed her suit in U.S. Federal Court and California State Court, December 7 2011 and is representing herself.  “For those with lawyers they can pay, take action as soon as possible.  You may even be able to find a pro bono lawyer who is committed to social justice.  Ask yourself, “What do you have to lose.”  Your home, dreams have been robbed already or are about to be.  Take action using the laws of the land.”

In the court filings Wright charges racketeering, unfair business practices, collusion between the courts, service agents, real estate agents, county officials and the bank, false advertising, & unfair handling of “cash for keys,” Feasting on the Poor In Secret by betting on home loans on the stock market, Blackmailing media for advertising dollars to keep the truth from being told and false advertising.

“So much attention is given in the media, of corner store robberies in minority neighborhoods, while respectable looking bankers have stolen our land and dreams,” said Wright.  We must make the banks pay for their Simon Legree Highway Robbery! It’s the American thing to do.  Everyone is equal under the law, right?  One vote, one voice, so I cast mine to see it’s true or whether big bucks buy justice or rather, buys injustice in America.  Don’t ask permission to bear arms.  Use your individual rights. Take action now!” 

Wright is not a lawyer.  “I urge people to “Occupy the Courts.”  Stop just camping out on the streets, occupy something that will affect the pocketbook of the banks and corporations and make them accountable,” said Wright.  “I have flung a rock at Wells Fargo Bank and it will be the power of the Lord God Almighty that makes my efforts effective.  Others may have another giant to slay.  I just call for people of America to wake up and use what is in their hand to do.  Use the laws of our land before lawmakers remake them to subvert justice.  If we find we can’t find redress in the courts, we will truly know America has been sold out.”

Beginning the journey in the courts, unemployed since being laid off January 8, 2007, Wright is filing "in forma pauperis" in federal court asking for a waiver of the filing fee.  Wright will have to find a pro bono lawyer or raise funds to keep her fight for justice in the courts alive.


On December 17, 2009, a week before Christmas, Wright witnessed nearly 100 people led by SEIU  (Service Employees International Union) protesting foreclosure.  It was sadly noted not one major corporate media outlet reported the action.  There was no San Francisco Chronicle; No San Francisco Examiner, No San Francisco Business Times, No KPIX, ABC 7, NBC 11, KRON, KTVU, KCBS Radio, KGO Radio.  This was an early indicator that the ubiquitous advertising of Wells Fargo Bank is affecting news coverage.  If actions like this had been reported Wright said "the 'Occupy Movement' would be camped at the right place, on the steps of those responsible."

"Not only has this country's financial stability be affected, the Fourth Estate is crumbling and a press encumbered with fear can't be a "Free Press" and we as a result will not be a "free nation" with justice for all."

Media Activist's December 7, 2011 Lawsuit Pleading Against Wells Fargo Bank

“Right is right and right don’t wrong nobody,” was often spoken to me by my great-grandmother Nora Henderson.  As I look at the facts surrounding my state of homeliness that was produced by
Wells Fargo Bank and its officers and board of directors, Alvarado & Associates, LLP (Raymond G. Alvarado, Esq. SB #50003 and Steven M. Lawrence, Esq. SB# 150861), Delta Ranches and Homes, the City of Antioch Mayor and Council and, the Contra Costa County Superior Court, the Contra Costa Board of Supervisors there was no “right “ in their individual and collective actions and so I have suffered emotionally, financially and physically.  As a result I plead my case to the courts of the United States of America Pauper Forma to see if righteousness can stand penniless before the courts and billion dollar corporations and those that are financed via the suffering of others and prevail or has the United States of America been sold out to the point that only those with financial superiority can prevail in the courts?

Whereas, Wells Fargo Bank was among the banks that received U.S. Taxpayers dollars in a very timely manner to save it’s business and proceeded to give executives bonuses on the backs of the poor people in the U.S.;

Whereas, Wells Fargo Bank pleaded before Congress to get taxpayers dollars, yet turned a deaf ear to one in worse financial straits than Wells Fargo;
Whereas, Wells Fargo Bank foreclosed on 2509 Johns Way, Antioch, CA where I resided in the county of Contra Costa did so with unfair business practices;
Whereas, Wells Fargo Bank had agreed to a short sale of my residence which the United States of America government had encouraged banks to do;
Whereas, Wells Fargo Bank although it had agreed to a short sale process and a sale was on the table, Wells Fargo executives proceeded with the foreclosure in the midst of the deal and began the process that resulted in my homelessness;
Whereas, Delta Ranches and Homes a representative of Wells Fargo Bank offered no more than $500 to me in the process they call “keys for cash” yet Wells Fargo Bank has provided “others” in the same situation amounts that were in alignment of what it takes to move in California;
Whereas, Alvarado & Associates, LLP began postings on my residence demanding I move without giving conversation no correspondence to the specifics of my situation;
Whereas, Alvarado & Associates, LLP hired local court filers who were familiar and well acquainted with the Contra Costa Court employees who were friendly with the court filers who did not give the same service to this plaintiff who was not familiar with their procedures

Whereas, there are unjust weights as a person without means of a lawyer and who has not the daily dealing with court employees resulting in unequal service;
Whereas, the Contra Costa Court Judge, whose ties with Wells Fargo Bank should be investigated, ruled against my plea for even a few days to keep me from being locked out of my residence without my personal belongings,
Whereas, the Contra Costa Court system unfairly favors corporations in its timing and rulings moving swiftly on behalf of corporations giving little time to the individual who has no money to deal with corporations who can hire law firms;
Whereas, the City of Antioch and Contra Costa County recipient of U.S. Taxpayers dollars to help those in foreclosure gave no response to my plea for assistance;
Whereas, United States law is based on Judeo-Christian scriptures which state “Do not enter the fields of the orphan or widows lest the Lord Your God Avenge them,’
Whereas, The United States Army knowingly sent into battle Sp5 Wyley Wright, Jr., an only son the father of four resulting in his death in Viet Nam, March 9, 1964 while honor guard for Secretary of Defense McNamara due to the incompetence of a pilot as recorded in the Gold Book and incident 62-01961;
Whereas, I as the oldest of the four children of Wyley Wright Jr. stand in my suffering state as a result of the laws of the land and the condition of our country that has allowed corporate greed to erode

the rights of “salt of the earth people” and have brought us to what the Prophet Habakkuk stated “they rejoice as those feeding on the poor in secret;”
Whereas, Wells Fargo Bank Board of Directors and Wells Fargo executive were asked to institute an alternative to allow time, even using their foundation to create an economic engine utilizing social services to generate funds for the mortgage of 2509 Johns Way, they did try to work things out with the “Kinsman Redeemer Foundation” and I was locked out of my home;
Whereas, my humiliation, stress and suffering culminated the night I came home from an evening of helping the San Francisco Economic Opportunity Council’s Youth Mentorship Program to find out that I had no home;
Whereas, Wells Fargo Bank is guilty of false advertising in that it gives the illusion of helping people with the American Dream yet it has been a nightmare for millions and it’s advertising does not align with the realities of its unfair business practices;
Whereas, Wells Fargo Bank has undermined  “Freedom of the Press” by advertising with corporate media that in turn does not cover the banks negative press as in the incident recorded at http://www.youtube.com/watch?v=WOlPCh6cqtE
Whereas, Wells Fargo Bank has undermined my professional work by ignoring my requests to do business with the company as a means to help generate funds that would not only assist community but generate money to repay the bank;

Whereas, Wells Fargo Banks duplicitous banking practices are evident in the media showing that to generate a profit at the expense of the poor;
Whereas, Wells Fargo Bank’s unfair business practices have brought great injury to me and my family and millions of other Americans;
Whereas, Wells Fargo Bank and its agents must be brought into accountability and are not above the law;
Whereas; as stated U.S. law is based on Judeo-Christian law, it is noted here that there is an even higher authority that has written:

Now listen, you rich people, weep and wail because of the misery that is coming upon you. Your wealth has rotted, and moths have eaten your clothes. Your gold and silver are corroded. Their corrosion will testify against you and eat your flesh like fire. You have hoarded wealth in the last days. Look! I plead before the Federal Court to do its earthly duty and hear my cries to redress the egregious actions that Wells Fargo, Alvarado and Associates, Delta Ranches and Homes Company, City of Antioch, Contra County Board of Supervisors, the Contra County Superior Court in a jury trial.

Baltimore, Memphis Fight Against Wells Fargo with New Lawsuits

(Reuters) - Baltimore and Memphis have filed new federal lawsuits accusing Wells Fargo & Co of steering black borrowers into expensive mortgages, only to later conduct many foreclosures that cost the cities property tax revenue and forced both to spend more on public safety.

The cities filed complaints on Wednesday, the same day Wells Fargo agreed to settle a National Association for the Advancement of Colored People lawsuit accusing it of steering blacks into subprime mortgages while giving comparable white borrowers better loan terms. As part of the accord, Wells Fargo will let the civil rights group review its lending practices.

"We stand by our fair and responsible lending practices," Wells Fargo spokesman Oscar Suris said on Thursday. "We believe we can accomplish more for homeowners through working with communities than having to respond to litigation. It is our hope that Baltimore and Memphis make that same choice soon."

Fourteen other lenders are still being sued by the NAACP, including Citigroup Inc, HSBC Holdings Plc and JPMorgan Chase & Co. President Benjamin Todd Jealous in a statement said the NAACP litigation is designed to change mortgage lenders' behavior, rather than seek monetary damages.

Based in San Francisco, Wells Fargo is the largest U.S. mortgage lender and the fourth-largest U.S. bank by assets. regulatory filings show.

Baltimore and Memphis both have more than 600,000 people, nearly two-thirds of whom identify themselves as black or African-American, U.S. census data show.

FAIR HOUSING VIOLATIONS ALLEGED

When it sued Wells Fargo in 2008, Baltimore became the first major American city to accuse a mortgage lender of violating the federal Fair Housing Act with predatory lending practices that exacerbated the nation's housing slump.

"Wells Fargo's discriminatory practices, and the resulting unnecessary foreclosures in the city's minority neighborhoods, have inflicted significant, direct, and continuing financial harm on Baltimore," that city said in a 107-page complaint filed Wednesday in Baltimore federal court.

George Nilson, Baltimore's city solicitor, said in an interview the new complaint follows unsuccessful efforts to settle the case over the last month, in talks initiated by the bank.

"I don't doubt that the people we talk to at Wells believe they behave extraordinarily well these days," he said. "I have a sense they really want to do better, but we are just not prepared to say: 'Forget about what happened before.'"

Memphis' lawsuit filed in December also alleged FHA violations. The 83-page amended complaint adds a claim that Wells Fargo also violated Tennessee consumer protection law.

Bradley Blower, a lawyer representing Memphis, said the amended complaint introduces evidence from former loan officers and branch managers about the bank's alleged "unfair and deceptive" lending practices, and shows 50 specific properties that together illustrate how Memphis incurs more costs when the bank makes home loans and then forecloses.

"We're hoping that Wells Fargo will do the right thing," Blower said, "but right now we're on the litigation track."

NAACP EYES OTHER SETTLEMENTS

Baltimore's amended complaint came three months after U.S. District Judge J. Frederick Motz dismissed its earlier complaint as too broad. He gave the city permission to sue over specific houses and neighborhoods where it believed damages might be traceable to specific Wells Fargo lending practices.

In its amended complaint, Baltimore identified specific expenses it said it incurred because of Wells Fargo foreclosures, including costs for inspections, condemnations and boarding up homes, and increased police and fire costs.

Baltimore also said it has lost property tax revenue both from foreclosed homes and from homes whose values fell because of large concentrations of nearby Wells Fargo foreclosures.

The NAACP, whose U.S. headquarters are in Baltimore, said its agreement with Wells Fargo includes a pledge that the bank will offer the "highest quality credit vehicle" appropriate to borrowers, while guarding against racial bias in lending.

"We are going to collaborate in communities across the country that have been underserved and badly served," NAACP General Counsel Laura Blackburne said in an interview.

Referring to other lenders that the NAACP is suing, she added: "By Wells taking this big leap forward, it may very well move a couple of others a little more quickly."

Wells Fargo shares closed up 24 cents, or 0.8 percent, at $32.23 on the New York Stock Exchange.

The Baltimore case is Mayor & City Council of Baltimore v. Wells Fargo Bank NA et al, U.S. District Court, District of Maryland, No. 08-00062. The Memphis case is City of Memphis et al v. Wells Fargo Bank NA et al, U.S. District Court, Western District of Tennessee, No. 09-02857.

Make Wells Fargo Accountable

With Wells Fargo doling out millions of dollars in these hard stressed times for advertising, can we expect the embattled television stations and print media to cover the growing actions against Wells Fargo. FACT SHEET ON WELLS FARGO DUPLICITY WITH HOMEOWNER IN ANTIOCH,CA

  • The house in which I live in Antioch, went into default and was about to be foreclosed on, but the owner began negotiations for a loan modification and ultimately worked out a deal for a short sale.
  • Well Fargo did not accept the first offer from a buyer in late fall '09. Finally, another offer came in and Wells Fargo accepted the offer by February 8, 2010.
  • As a tenant I was preparing myself to move out of the house with an expectation of having 60 days for the sale to go through.
  • On Valentine's Day I returned home to find a upsetting and embarrassing notice on the Door with blue broad tape that said Wells Fargo had foreclosed on the house and I had to move.
  • Without notice to the landlord, Wells Fargo although having a contract in hand, reneged on the contract to take the listing from the Real Estate Company employed by the landlord that had worked out the deal and immediately gave it to another company. The relationship with the new real estate company had to have been already established. 
  • In a cash for keys offer, the new real estate agent said she could offer me $500 to move out. In California that would barely pay for a Uhaul truck.

  • I immediately began writing our public servants such as Senator Dianne Feinstein,
  • California Attorney General Edmund Brown and the Department of Justice.
  • The questions I am raising are Is Wells Fargo Business Practices right given they were bailed out yet they reneged on a deal causing stress and additional financial hardship for the landlord and tenant?; Who is Wells Fargo doing business with as foreclosures disproportionately affect minorities? Are they doing business with minority real estate companies, brokers and services (clearing and cleaning houses etc.) on the level of the statistics of those foreclosed on?; Bottom line is Wells Fargo benefiting from the financial hardships of minorities coming and going? Is there collusion between Wells Fargo Bank executives and the businesses they choose to do business with in the aftermath of this financial downturn and high foreclosures among minorities. With the force of monies made with "ghetto loan" ( one executive making $700,00 a year in incentives and salary from such admitted practices), should not Wells Fargo be held accountable?
  • By Wells Fargo reneging on a deal that is on the table,without notice, one accepted by one of their agents, the landlord was not able to protect her property through the laws of the land such as bankruptcy, additionally the foreclosure will make it difficult for her to find a job.
  • Although a week prior to the foreclosure the landlord had received a good review from her employer, one week after the foreclosure, she was terminated from her job.
